Bonus Program Information
Eligibility

  • All contracted brokers or entities with an assigned e123 website link (the bonus program is based on plans sold through one assigned e123 website link) are eligible to participate.

  • Bonus Program ends at midnight on December 23rd, 2023, and first month premium paid.

  • Bonuses are paid only to a contracted broker or entity one time for each level exceeded.

  • Bonuses will be paid and accumulated for each target level reached (50, 150, 500, and 1,000 plan sales levels).  For example, a broker who exceeds 1,000 plan sales, accumulative bonuses would be the 1,000 plan sales bonus + $13,500.

Prize Value and Taxes

  • Bonuses are considered income for tax purposes.  Please inquire with your accountant regarding potential tax implications.

  • Bonus for broker/entity surpassing 1,000 plan sales has an approximate retail value (ARV) of $30,000.

Verification

  • Brokers will be notified by January 2nd, 2024 of bonus levels achieved.

  • Bonus prize for 1,000 sales must be booked no later than August 1st, 2024.

  • Condo booked on behalf of The Island Project via Waikiki Beach Tower.

  • Air travel booked through travel agency TBD.

Disclaimer

By participating in the JKB Consulting Group, LLC Hawaii trip bonus giveaway, broker(s) acknowledge and agree to the following terms and conditions:

  • Assumption of Risk: JKB Consulting Group, LLC and its affiliates are not liable for any accidents, injuries, or losses that may occur during the Trip. Travel and adventure inherently involve risks, including but not limited to, accidents, injuries, property damage, and unforeseen events. By participating in the Trip, you acknowledge and accept these risks.

  • Liability Waiver and Release: All Trip winners are required to sign a liability waiver and release before embarking on the Trip. The Waiver is a legally binding document that exempts JKB Consulting Group, LLC from any liability or responsibility for any claims, actions, damages, expenses, or losses arising from the Participant's participation in the Trip. The Waiver is intended to protect the Company from legal claims and disputes.

Governing Law and Dispute Resolution Statement for the Broker Bonus Program

 

This Governing Law and Dispute Resolution Statement governs the Broker Bonus Program offered by JKB Consulting Group, LLC. By participating in the Broker Bonus Program, you agree to the following:

 

Governing Law and Jurisdiction: The Broker Bonus Program and any disputes arising from or related to it shall be governed by and construed in accordance with the laws of the state of Missouri, United States, without regard to its conflict of laws principles. Any legal action or proceeding relating to the Broker Bonus Program shall be filed and conducted exclusively in the state or federal courts located within the state of Missouri.

 

Dispute Resolution: JKB Consulting Group, LLC is committed to fair and efficient dispute resolution processes. In the event of any dispute, controversy, or claim arising out of or in connection with the Broker Bonus Program, including disputes related to eligibility, rewards, or any other program-related matter, the following dispute resolution process shall apply:

  1. Negotiation and Informal Resolution: In the event of a dispute, participants and JKB Consulting Group, LLC shall first attempt to resolve the matter amicably through good-faith negotiation. Either party may initiate this process by providing written notice to the other party, outlining the nature of the dispute and the desired resolution. Both parties agree to participate in such negotiations in a cooperative and constructive manner.

  2. Mediation: If the dispute cannot be resolved through negotiation within a reasonable timeframe or if both parties agree to skip the negotiation stage, the parties shall submit the dispute to mediation. Mediation will be conducted by a neutral, third-party mediator mutually agreed upon by both parties. The mediator's role is to facilitate communication and assist the parties in reaching a mutually acceptable resolution. The cost of mediation shall be shared equally between the parties.

  3. Arbitration: If mediation is unsuccessful or not chosen as the initial dispute resolution method, any unresolved dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration service. The arbitration shall take place in the state of Missouri, and the arbitrator's decision shall be final and binding on both parties. The cost of arbitration shall be borne by the party against whom the arbitrator rules, or as otherwise determined by the arbitrator.

  4. Equitable Relief: Notwithstanding the above dispute resolution processes, either party may seek equitable relief, such as an injunction or specific performance, from a court of competent jurisdiction to prevent or address ongoing harm or violations of intellectual property rights.

 

By participating in the Broker Bonus Program, you acknowledge and agree to this Governing Law and Dispute Resolution Statement. You further agree that any dispute resolution process pursued under this statement shall be the exclusive means for resolving disputes related to the Broker Bonus Program.

Modification or Cancellation Disclaimer for JKB Consulting Group, LLC Broker Bonus Program

 

JKB Consulting Group, LLC values your participation in our Broker Bonus Program. We strive to provide you with the best possible experience and rewards. However, we want to make it clear that JKB Consulting Group, LLC reserves the right to modify, cancel, or terminate the Broker Bonus Program at any time and for any reason, with or without notice. By participating in this program, you acknowledge and agree to the following:

  1. Modification: JKB Consulting Group, LLC may, at its sole discretion, modify any aspect of the Broker Bonus Program, including but not limited to bonus criteria, reward structure, eligibility requirements, and program duration. Such modifications may occur at any time and without prior notice.

  2. Cancellation or Termination: JKB Consulting Group, LLC may, at its sole discretion, cancel or terminate the Broker Bonus Program in its entirety. This may happen for various reasons, including changes in business strategy, market conditions, or for any other reason deemed necessary by JKB Consulting Group, LLC. In the event of cancellation or termination, JKB Consulting Group, LLC is not obligated to provide any prior notice.

  3. Effect of Modification or Cancellation: In the event of modification, cancellation, or termination of the Broker Bonus Program, JKB Consulting Group, LLC will not be liable for any loss or inconvenience that may be incurred by participants or affected parties. This includes but is not limited to the loss of expected rewards, bonuses, or other benefits.

  4. Communication: While JKB Consulting Group, LLC will strive to communicate any significant changes or cancellations through appropriate channels, participants are encouraged to periodically review the program's terms and conditions for updates.

  5. No Guarantees: Participation in the Broker Bonus Program does not guarantee the continuation of the program, specific rewards, or any particular level of compensation. The program's availability and terms are subject to change at JKB Consulting Group, LLC's discretion.

 

By participating in the Broker Bonus Program, you acknowledge that you have read and understood this Modification or Cancellation Disclaimer, and you agree to abide by any modifications or cancellations made by JKB Consulting Group, LLC. JKB Consulting Group's decisions regarding the program are final.

Publicity and Consent Statement for Broker

 

By participating in the Broker Bonus Program offered by JKB Consulting Group, LLC, you hereby acknowledge and agree to the following terms regarding the use of your name, likeness, and related information for publicity purposes:

 

Publicity Consent:

  1. Authorization: You grant JKB Consulting Group, LLC and its affiliates the non-exclusive right and permission to use, reproduce, and distribute your name, likeness, image, voice, and any other identifying information (collectively, "Your Likeness") in connection with the promotion, advertisement, or publicity of the Broker Bonus Program, including but not limited to:

    • Marketing materials

    • Website content

    • Social media posts

    • Press releases

    • Advertising campaigns

  2. No Compensation: You understand and agree that you will not be entitled to any compensation, financial or otherwise, for the use of Your Likeness as described herein.

  3. Duration: This consent shall remain in effect for the duration of your participation in the Broker Bonus Program and for a reasonable period thereafter to allow for the fulfillment of any promotional materials or campaigns initiated during your participation.

 

Withdrawal of Consent:

  1. You have the right to withdraw your consent for the use of Your Likeness at any time. To do so, you must provide written notice to JKB Consulting Group, LLC specifying your withdrawal of consent.

  2. Upon receipt of your withdrawal notice, JKB Consulting Group, LLC will make reasonable efforts to cease using Your Likeness for future promotional activities, but it may not be possible to recall materials or advertisements already in circulation.

 

Confidential Information:

JKB Consulting Group, LLC shall not disclose any confidential or proprietary information about you in connection with the use of Your Likeness. The use of Your Likeness is limited to promoting the Broker Bonus Program and related activities.

 

Release and Waiver:

By participating in the Broker Bonus Program, you release and discharge JKB Consulting Group, LLC, its officers, directors, employees, agents, representatives, and affiliates from any claims, actions, demands, or liabilities that may arise from the use of Your Likeness in accordance with this statement.
